General Conditions of the “Coconut Three Milk Cake Recipe” Contest - Domino®KIWILIMÓN®GENERAL CONDITIONS OF THE CONTESTThis contest is presented by Kiwilimón, S.A.P.I. de C.V. (“Kiwilimón®”) and Domino® 1.- Conditions to participate. All users who are of legal age and residents of the United Mexican States (Mexico) can participate. IMPORTANT: If you are selected and live outside Mexico City and/or the Metropolitan Area, shipping costs will be covered by Kiwilimón®.Contest Features:1) The user must upload a photograph in the related Facebook posts showing the result of the preparation of the recipe from the live class with Chef Yolo. 2) The photograph must show the dish with the presentation that the user prefers and with one of the Domino® brown sugar presentations. 3) Those who upload their photograph between May 6 and May 19, 2021, will participate.  4) The winning photographs will be selected by a committee from the Domino® brand.2.- Editorial Principles. Through this contest, Kiwilimón® seeks to promote: a) Honesty: The photograph you share must be your own. b) Respect and camaraderie: Kiwilimón® through this and all its contests, seeks to communicate users with each other, as well as with the page administrators, in the pursuit of a space that connects the ideas and creativity of users, so we appreciate if you avoid giving negative comments to other competing individuals.For the above, to safeguard these principles, Kiwilimón® reserves the right to disqualify any user from the contest who presents behaviors contrary to good practices and the ethical principles outlined in sections a) and b) of this point, at its sole discretion and without prior notice. Likewise, Kiwilimón® reserves the right to disqualify all participants who alter or attempt to alter or manipulate the contest. 3.- Contest Mechanics. To participate in this contest:a) Prepare the coconut three milk recipe from Yolo's class, and take a photograph with one of the Domino® brown sugar presentations.b)      Upload your photograph from May 6 to May 19, 2021, on Facebook. d) The winner will be announced on Wednesday, May 26, 2021, through a story on Kiwilimón®'s account on the social network Facebook®. Kiwilimón® will contact the winner through this same social network and via email at concursos@kiwilimon.com4.- Selection Criteria. The finalists will be chosen by the Domino® brand committee team according to the following criteria:a) Sharpness of the photograph (the image must have the necessary resolution to be appreciated by other participants).  b) Clarity of content (the recipe and the Domino® brown sugar presentation must be distinguishable). c) Final presentation of the recipe.d) Only photographs uploaded on the social network Facebook® will be taken into account.5.- Validity* • You can participate until May 19, 2021. The winner will be announced on Wednesday, May 26, 2021, through a story on Kiwilimón®'s account on the social network Facebook®. Kiwilimón® will contact the winner through this same social network and via email at concursos@kiwilimon.com*The validity of the contest may be extended at Kiwilimón®'s discretion, for which the corresponding announcement will be published through the same digital medium and with the consent of the Domino® brand.6.- Winner's Prize.2 winners will be chosen to whom the following prizes will be awarded:*1st place Kitchen Aid Ultra Power Plus Red Mixer  *2nd place RCA RC-106 3.6L Oil-Free Electric Fryer White 120VThe personal data and address of each winner will be requested via email at concursos@kiwilimon.com, and shipping will be done via courier within 10 to 20 working days.Currently, this contest is only for residents of the Mexican Republic. We appreciate your understanding if you reside abroad, but we invite you to closely follow all Kiwilimón® contests. 7.- Exclusions of Liability. Kiwilimón® is not responsible for failures or errors that occur at any stage of this contest due to fortuitous events or force majeure, including any failure in the system and/or social network used that is not attributable or foreseeable.8.- Contact and Legal. Participation in this contest implies acceptance of these conditions. The user participating in this contest expressly acknowledges that the photograph with which they compete has not been taken from another source and/or altered, but is original, thus recognizing and guaranteeing that it does not violate any intellectual property rights of third parties; likewise, they undertake to hold Kiwilimón® harmless from any claim, lawsuit, or legal action from third parties that may arise, as well as to indemnify it for any expenses incurred by Kiwilimón® in the event of any controversy. Likewise, it is understood that, by participating in this contest: (i) the user expressly and irrevocably grants Kiwilimón all the economic rights derived from the photographs that users send to Kiwilimón® to participate, with the user reserving no rights. For these purposes, “economic rights” are understood as those indicated in Articles 24 to 29 and other related and applicable provisions of the Federal Copyright Law; and (ii) the user expressly authorizes Kiwilimón® to reproduce the photograph(s) with which they participate, even if such photographs include images of themselves or other persons participating in this contest, with such images understood as “moral rights” in terms of Articles 18 to 23 and other related and applicable provisions of the Federal Copyright Law, with the user reserving no rights. By virtue of the above, Kiwilimón® will be empowered to exploit any of the photographs that the user shares to participate in the contest, including but not limited to: disclosure, dissemination, publication, production, transmission, printing, recording, editing, exhibition, modification, instrumentation, public communication, distribution to the public (with or without advertising purposes), translation, reproduction, adaptation, compilation, paraphrasing, arrangement, or any other form of exploitation permitted by the Federal Copyright Law and Articles 16, 21, 24, 30, 31, 83 bis and other related and applicable provisions of the same regulation, as well as the legislation of the subject. Such exploitation may be carried out in the United Mexican States or abroad. By virtue of the above, Kiwilimón® will be the sole owner of the economic rights of authorship derived from the photographs; as a result, Kiwilimón® may also assign, license, encumber, or dispose of these rights in any form, either wholly or partially, as it deems appropriate, without the undersigned having any right to subsequent payment.
