General Conditions of the Contest “Live Class – Carbonell, Love is Cooked at Home”KIWILIMÓN®GENERAL CONDITIONS OF THE CONTESTThis contest is presented by Kiwilimón, S.A.P.I. de C.V. (“Kiwilimón®”) and Carbonell]1.- Conditions to Participate: All users residing in the United Mexican States (Mexico) may participate. IMPORTANT: if you are selected and live outside Mexico City and/or the Metropolitan Area, travel expenses will be covered by Kiwilimón®.Contest Features:The user must upload a photograph in the comments of the live class or in the related Facebook posts showing the result of preparing one of the recipes shown in the class.The photograph must show the dish with the presentation the user prefers, although the one that is most similar will win.Those who upload their photograph within the dates from May 7 to May 14, 2020.The winning photographs will be selected by Carbonell.2.- Editorial Principles: Through this contest, Kiwilimón® seeks to promote: Honesty: The photograph you share must be your own.Respect and camaraderie: Kiwilimón® through this and all its contests seeks to communicate users with each other, as well as with the page administrators, in the search for a space that connects users' ideas and creativity, so we would appreciate it if you avoid giving negative comments to others competing.For the above, to safeguard these principles, Kiwilimón® reserves the right to disqualify any user from the contest who displays behaviors contrary to the principles outlined in subsections a) and b) of this point, at its sole discretion and without prior notice. Likewise, Kiwilimón® reserves the right to disqualify all participants who alter or attempt to alter or manipulate the contest.3.- Contest Mechanics: To participate in this contest:Watch the Live Class Love is Cooked at Home on May 7, 2020, at 12:00 pm through the Kiwilimón Facebook® social network.Prepare the recipe shown in the class and take a photograph of it.Upload your photograph from May 7 to May 14, 2020 in the comments of the live class video broadcasted through the Kiwilimón social network on Facebook or in the related Facebook posts. It must be a photo of the dish with the Beef Stew recipe, where the participant's face is visible and in the comment, they should describe what they liked most about making the recipe.The winners will be announced on May 18, 2020.4.- Selection Criteria: The finalists will be chosen by the Carbonell team based on the following criteria:Clarity of the photograph (the image must have the necessary resolution to be appreciated by other participants)Clarity of the content (it must be distinguishable that it is the recipe or recipes from the live class)Final presentation of the recipe (which should be similar to that shown in the live class)Consistency with the content requested in the class.e) Only photographs uploaded on the Facebook® social network will be taken into account.5.- Validity*: • You can participate until May 14, 2020.• The winner or winners will be announced on May 18, 2020 through a post on Kiwilimón®'s Facebook® account. Kiwilimón® will contact the winner through this same social network and via email at concursos@kiwilimon.com*The validity of the contest may be extended at Kiwilimón®'s discretion.6.- Winner's Prize: 10 winners will be chosen, who will receive as a prize a “Love is Cooked at Home” Kit from Carbonell, which includes:1 Bottle of Carbonell Extra Virgin Olive Oil Special Selection 750ml1 Can of Pure or Classic Olive Oil1 Bottle of Carbonell Touch of Olive1 Jar of Carbonell Olives3 Cans of Olives stuffed with Pepper, Serrano Ham, and Blue Cheese.One bottle of Carbonell Vinegar or 1 bottle of Balsamic Vinegar Cream.Personal data and address of each winner will be requested via email at concursos@kiwilimon.com to arrange shipping by courier within 10 to 20 working days.Currently, this contest is only held for residents in Mexico. Participation in this contest implies acceptance of these conditions. The user participating in this contest expressly acknowledges that the photograph with which they are competing has not been taken from another source and/or altered, but is original, thus recognizing and guaranteeing that it does not infringe any third-party intellectual property rights; likewise, they undertake to hold Kiwilimón® harmless from any claim, lawsuit, or legal action from third parties that may arise, as well as to indemnify it for any expenses incurred by Kiwilimón® in the event of any controversy. Furthermore, it is understood that by participating in this contest: (i) the user expressly and irrevocably cedes free of charge to Kiwilimón all property rights derived from the photographs that users send to Kiwilimón® to participate, not reserving any rights; for such purposes, “property rights” are understood as those outlined in articles 24 to 29 and other related and applicable provisions of the Federal Copyright Law; and (ii) the user expressly authorizes Kiwilimón® to reproduce the photograph(s) with which they participate, even if such photographs include images of themselves or other participants in this contest, understood as “moral rights” in terms of articles 18 to 23 and other related and applicable provisions of the Federal Copyright Law, not reserving any rights. As a result of the above, Kiwilimón® will be empowered to exploit any of the photographs that the user shares to participate in the contest, including but not limited to: disclosure, dissemination, publication, production, transmission, printing, recording, editing, exhibition, modification, instrumentation, public communication, distribution to the public (with or without advertising purposes), translation, reproduction, adaptation, compilation, paraphrasing, arrangement, or any other form of exploitation permitted by the Federal Copyright Law and articles 16, 21, 24, 30, 31, 83 bis, and other related and applicable provisions thereof, as well as the legislation in this area. Such exploitation may be carried out in the United Mexican States or abroad.Consequently, Kiwilimón® will be the sole holder of the property rights derived from the photographs; as a consequence, Kiwilimón® may assign, license, encumber, or sell these rights in any form, either totally or partially as it deems appropriate, without the undersigned having any right to subsequent payment.
