(“Kiwilimón®”) and Weber-Stephen Products S.A. de C.V. (Weber®)1.- Conditions to participate: All users residing in the United Mexican States (Mexico) may participate. IMPORTANT: if you are selected and live outside Mexico City and/or the Metropolitan Area, travel expenses will be covered by Kiwilimón®. Contest Features:The user must tag 2 people who do not follow @kiwilimon on Instagram® in the comments of the post made by Kiwilimón® and must complete the phrase: “with my @webergrillmex I...”The 2 tagged people must follow @kiwilimon on Instagram® from the date they were tagged.Those who comment on Kiwilimón®'s post and tag 2 new followers on Instagram® will participate from July 29 to August 2, 2019.The same user can participate as many times as they wish as long as they tag 2 different people.2.- Editorial Principles: Through this contest, Kiwilimón® seeks to promote:Honesty: Fake profiles should not be tagged, nor should there be previous followers of @kiwilimon on the Instagram® social network.Respect and camaraderie: Kiwilimón® seeks to communicate users with each other, as well as with the page administrators, in the search for a space that connects users' ideas and creativity, so we appreciate it if you avoid giving negative comments to other competitors.For the above reasons, to safeguard these principles, Kiwilimón® reserves the right to disqualify any user from the contest who exhibits behavior contrary to the principles outlined in subsections a) and b) of this point, at its sole discretion and without prior notice. Likewise, Kiwilimón® reserves the right to disqualify from the contest any participants who alter or attempt to alter or manipulate the contest.3.- Contest Mechanics: To participate in this contest:Check the post related to the Giveaway made on the @kiwilimon profile on July 29, 2019 through the Instagram® social network.The user must tag 2 (two) people who do not follow @kiwilimon on Instagram® in the comments of the post, completing the phrase: “with my @webergrillmex I...”.The 2 (two) tagged people must follow @kiwilimon on Instagram® from the date they were tagged.Those who comment and tag 2 new users from July 29 to August 2, 2019 will participate, and the winner will be announced on August 5, 2019.4.- Selection Criteria:The winner will be chosen at random using applications similar to Comment Picker®, where the total comments of the post will be entered, and those finalists who meet the aforementioned Contest Features will be randomly selected.Users who make more comments on the post will have more opportunities to be chosen.Only comments made on the Instagram® social network on the Kiwilimón account will be considered.5.- Validity*:You can participate until July 29 and until August 2, 2019.The winner will be announced on August 5, 2019, through a post on the official Kiwilimón® account on the Instagram® social network. The user participating in this contest expressly acknowledges that the photograph with which they are competing has not been taken from another source and/or altered, but is original, thus recognizing and guaranteeing that it does not violate any third-party intellectual property rights; likewise, they undertake to hold Kiwilimón® harmless from any claim, lawsuit, or legal action by third parties that may arise, as well as to indemnify Kiwilimón® for any expenses incurred by Kiwilimón® in case of any controversy. Likewise, it is understood that by participating in this contest: (i) the user expressly and irrevocably grants Kiwilimón all moral rights derived from the photographs that users send to Kiwilimón® to participate, not reserving any rights; for such purposes, “moral rights” are understood as those indicated in articles 24 to 29 and other related and applicable provisions of the Federal Copyright Law; and (ii) the user expressly authorizes Kiwilimón® to reproduce the photograph(s) with which they participate, even if such photographs include images of themselves or people participating in this contest, understood as “moral rights” in terms of articles 18 to 23 and other related and applicable provisions of the Federal Copyright Law, not reserving any rights. Consequently, Kiwilimón® will be empowered to exploit any of the photographs that the user shares to participate in the contest, including but not limited to: dissemination, publication, production, transmission, printing, recording, editing, exhibition, modification, instrumentation, public communication, distribution to the public (with or without advertising purposes), translation, reproduction, adaptation, compilation, paraphrasing, arrangement, or any other form of exploitation permitted by the Federal Copyright Law and articles 16, 21, 24, 30, 31, 83 bis and other related and applicable provisions, as well as the legislation on the subject. Such exploitation may be carried out in the United Mexican States or abroad.As a result, Kiwilimón® will be the sole owner of the moral rights derived from the photographs; consequently, Kiwilimón® may in turn assign, license, encumber or alienate these rights in any form, either totally or partially when it deems appropriate, without the undersigned having any right to subsequent payment.
