General Conditions of the Live Class Contest – Qualtia

GENERAL CONDITIONS OF THE CONTESTThis contest is presented by Kiwilimón, S.A.P.I. de C.V. (“Kiwilimón®”) and (Qualtia®)1.- Conditions to participate: All users residing in the United Mexican States (Mexico) may participate. IMPORTANT: If you are selected and live outside Mexico City and/or the Metropolitan Area, travel expenses will be covered by Kiwilimón®. Characteristics of the Contest:You must attend the live class that will be broadcast on January 14, 2021, at 1:00 p.m. through the social network Facebook®, transmitted on the Kiwilimón® account.You must prepare the recipe shown in the class mentioned in the previous item and take a photograph of the dish.The user must upload the photograph in the comments of the live class or in the posts published through Kiwilimón®'s social network on Facebook®, or on Instagram mentioning @Kiwilimon and @Zwan_mx with the hashtags #ClaseDeCocina #Zwantástica.The photograph must show the dish created by the user.Those who upload their photograph from January 14, 2021, to January 21, 2021, will participate.The winning photographs will be selected by Qualtia®.2.- Editorial Principles: Through this contest, Kiwilimón® seeks to promote: Honesty: The photograph you share must be your own.Respect and camaraderie: Kiwilimón® through this and all its contests seeks to communicate users with each other, as well as with the page administrators, in the search for a space that connects the ideas and creativity of users; therefore, we appreciate it if you avoid making negative comments about other participants.For the above, to safeguard these principles, Kiwilimón® reserves the right to disqualify any user from the contest who exhibits behavior contrary to the principles outlined in items a) and b) of this point, at its sole discretion and without prior notice. Likewise, Kiwilimón® reserves the right to disqualify all participants who alter or attempt to alter or manipulate the contest. 3.- Contest Mechanics: To participate in this contest:You must attend the live class, which will be broadcast on January 14, 2021, at 1:00 p.m. through the social network Facebook®, transmitted on the Kiwilimón® account.You must prepare the recipe shown in the class mentioned in the previous item, and take a photograph of the dish.The user must upload the photograph in the comments of the live class or in the posts published through Kiwilimón®'s social network on Facebook®, or on Instagram mentioning @Kiwilimon and @Zwan_mx with the hashtags #ClaseDeCocina #Zwantástica.The photograph must show the dish created by the user.Those who upload their photograph from January 14, 2021, to January 21, 2021, will participate.The winning photographs will be selected by Qualtia®.The winner will be announced on January 25, 2021, in a story on Kiwilimón®'s Facebook® account.4.- Selection Criteria: The finalists will be chosen by the Qualtia® team according to the following criteria:Sharpness of the photograph (the image must have the necessary resolution to be appreciated by other participants).Clarity of the content (it should be clear that it is the recipe from the live class).Final presentation of the recipe (it should be similar to that shown in the live class).Consistency with the content requested in the class.Only photographs uploaded to the Facebook® social network will be considered.5.- Validity*: You can participate until January 21, 2021.The winners will be announced on January 25, 2021, through a story on Kiwilimón®'s Facebook® account. Kiwilimón® will contact the winner via this social network and through the email concursos@kiwilimon.com *The validity of the contest may be extended at the discretion of Kiwilimón®. 6.- Winner's Prize: 1 (one) winner will be chosen to whom the following prize will be awarded: 1 (one) microwave oven from the WINIA brand.Personal data and address of each winner will be requested via email at concursos@kiwilimon.com for shipping via courier within 10 to 20 business days.At the moment this contest is only for residents in Mexico. Participation in this contest implies acceptance of these conditions. The user participating in this contest expressly acknowledges that the photograph with which they are competing has not been taken from another source and/or altered, but is original, thereby recognizing and guaranteeing that it does not violate any third-party intellectual property rights; likewise, they undertake to hold Kiwilimón®, the Qualtia® brand, any of its affiliates, as well as anyone representing their rights harmless from any claim, lawsuit, or legal action from any authority or third party that may arise, as well as indemnifying any expenses incurred by Kiwilimón®, the Qualtia® brand, or any of its affiliates, as well as anyone representing their rights in the event of any controversy. Furthermore, it is understood that by participating in this contest: (i) the user expressly and irrevocably transfers free of charge to Kiwilimón® all economic rights deriving from the photographs submitted by users to Kiwilimón® for participation, reserving no rights for the user. For these purposes, economic rights means those indicated in Articles 24 to 29 and other related and applicable provisions of the Federal Copyright Law; and (ii) the user expressly authorizes Kiwilimón® to reproduce the photograph(s) submitted for participation, even if such photographs include images of themselves or individuals participating in this contest, understood as “moral rights” in terms of Articles 18 to 23 and other related and applicable provisions of the Federal Copyright Law, reserving no rights for the user. Consequently, Kiwilimón® will be authorized to exploit any photographs shared by the user to participate in the contest, including but not limited to: dissemination, publication, production, transmission, printing, recording, editing, exhibition, modification, instrumentation, public communication, distribution to the public (with or without advertising purposes), translation, reproduction, adaptation, compilation, paraphrasing, arrangement, or any other form of exploitation permitted by the Federal Copyright Law and Articles 16, 21, 24, 30, 31, 83 bis and other related and applicable provisions of the same legal framework, as well as relevant legislation. Such exploitation may take place in the United Mexican States or abroad. For the above reasons, Kiwilimón® will be the sole owner of the economic rights derived from the photographs; as a result, Kiwilimón® may in turn assign, license, encumber, or alienate these rights in any form, either in whole or in part, when it deems appropriate, without the undersigned having any right to subsequent payment.
