General Conditions of the “Live Class – Oli de Nutrioli” ContestKIWILIMÓN®GENERAL CONDITIONS OF THE CONTESTThis contest is presented by Kiwilimón, S.A.P.I. de C.V. (“Kiwilimón®”) and Oli de Nutrioli)1.- Conditions to participate: All users residing in the United Mexican States (Mexico) are eligible to participate. IMPORTANT: if you are selected and live outside Mexico City and/or the Metropolitan Area, travel expenses will be covered by Kiwilimón®.Contest Features:The user must upload a photograph in the comments of the live class or in related posts on Facebook showing the result of preparing one of the recipes shown in the class.The photograph must showcase the dish with the presentation that the user prefers.Those who upload their photograph within the dates June 11 to June 18, 2020.The winning photographs will be selected by a committee from the Oli de Nutrioli brand.2.- Editorial Principles: Through this contest, Kiwilimón® aims to promote: Honesty: The photograph you share must be your own.Respect and camaraderie: Kiwilimón® through this and all its contests seeks to communicate among users as well as with the page administrators, in the pursuit of a space that connects users' ideas and creativity, therefore we appreciate avoiding negative comments towards other participants who are competing.To safeguard these principles, Kiwilimón® reserves the right to disqualify any user from the contest who exhibits behaviors contrary to the principles outlined in items a) and b) of this section, at its sole discretion and without prior notice. Additionally, Kiwilimón® reserves the right to disqualify from the contest any participants who alter or attempt to alter or manipulate the contest.3.- Contest Mechanics: To participate in this contest:Watch the Live Class: Spaghetti with Meatballs and Apple Salad with 2 Vinaigrettes on June 11, 2020, at 12:00 PM through the Facebook® social network.Prepare one of the recipes shown in the class and take a photograph of it.Upload your photograph from June 11 to June 18, 2020 in the comments of the live class video broadcasted through Kiwilimón's Facebook social network or in related Facebook posts. It must be a photo of Spaghetti with Meatballs or the Apple Salad with one of the vinaigrettes. The photo should include the Oli de Nutrioli bottle and in the comment write: Who did you share these exquisite recipes with?The winners will be announced on June 24, 2020.4.- Selection Criteria: The finalists will be chosen by the Oli de Nutrioli brand committee, according to the following criteria:Clarity of the photograph (the image must have the necessary resolution to be appreciated by other participants)Clarity of the content (it must be evident that the photos are of the recipes from the live class)Final presentation of the recipe (it should be similar to what was shown in the live class)Consistency with the content requested in the class.Only photographs uploaded on the Facebook® social network will be considered.5.- Validity*: • You can participate until June 18, 2020.• The winner or winners will be announced on June 24, 2020 through a post on Kiwilimón's® Facebook account. The user participating in this contest expressly acknowledges that the photograph with which they are competing has not been taken from another source and/or altered, but is original, thereby recognizing and guaranteeing that it does not infringe any intellectual property rights of third parties; likewise, they agree to hold Kiwilimón® harmless from any claim, lawsuit, or legal action from third parties that may arise, as well as to indemnify Kiwilimón® for any expenses incurred due to any controversy. Furthermore, it is understood that by participating in this contest: (i) the user expressly and irrevocably grants Kiwilimón all the economic rights derived from the photographs submitted by the users to participate, not reserving any rights for themselves. For these purposes, “economic rights” refer to those specified in Articles 24 to 29 and other relevant and applicable provisions of the Federal Copyright Law; and (ii) the user expressly authorizes Kiwilimón® to reproduce the photograph(s) submitted, even if such photographs include images of themselves or other individuals participating in this contest, with these images understood as “moral rights” in terms of Articles 18 to 23 and other relevant and applicable provisions of the Federal Copyright Law, without reserving any rights for themselves. Accordingly, Kiwilimón® will be entitled to exploit any of the photographs shared by the user to participate in the contest, including but not limited to: disclosure, dissemination, publication, production, transmission, printing, recording, editing, exhibition, modification, implementation, public communication, distribution to the public (with or without advertising purposes), translation, reproduction, adaptation, compilation, paraphrasing, arrangement, or any other form of exploitation permitted by the Federal Copyright Law and Articles 16, 21, 24, 30, 31, 83 bis and other relevant and applicable provisions of the same legislation, as well as any applicable legislation. This exploitation may take place in the United Mexican States or abroad. As a result, Kiwilimón® will be the sole holder of the economic copyright derived from the photographs; consequently, Kiwilimón® may also assign, license, encumber, or alienate these rights in any form, either totally or partially, as it deems appropriate, without the undersigned having any right to subsequent payment.
