General Conditions of the Mickey Mouse Gelatin ContestKIWILIMÓN®GENERAL CONDITIONS OF THE CONTEST This contest is presented by Kiwilimón, S.A.P.I. de C.V. (“Kiwilimón®”) 1.- Conditions to participate: All users residing in the United Mexican States (Mexico) may participate. IMPORTANT: if you are selected and live outside Mexico City and/or the Metropolitan Area, travel expenses will be covered by Kiwilimón®. Contest Features: The user must upload a photograph to the comments of the class or in related posts on Facebook and Instagram showing their result of preparing the Mickey Mouse Gelatin. The photograph must show the dish with the presentation the user prefers, although the most similar one will be the one that wins. Those who upload their photograph between July 17 and July 24, 2019, will participate. The winning photographs will be selected by Kiwilimón. 2.- Editorial Principles: Through this contest, Kiwilimón® seeks to promote: a) Honesty: The photograph you share must be your own. b) Respect and camaraderie: Kiwilimón® through this and all its contests, seeks to communicate users with each other, as well as with the page administrators, in the pursuit of a space that connects the ideas and creativity of users, therefore we appreciate it if you avoid giving negative comments to other competing individuals. For the above, to safeguard these principles, Kiwilimón® reserves the right to disqualify any user from the contest who exhibits behaviors contrary to the principles outlined in sections a) and b) of this point, at its sole discretion and without prior notice. Likewise, Kiwilimón® reserves the right to disqualify any participants who alter or attempt to alter or manipulate the contest. 3.- Contest Mechanics: To participate in this contest: a) Watch the class video published on July 17 through the social network Facebook®. b) Prepare the Mickey Mouse Gelatin shown in the class and take a photograph of it. c) Upload your photograph from July 17 to July 24 in the comments of the class video published on Facebook or in the related posts on Facebook and Instagram along with the hashtag #RetoMickey d) The winners will be announced on July 26, 2019. 4.- Selection Criteria: The finalists will be chosen by the Kiwilimón team according to the following criteria: a) The photograph published by each user must include the hashtag #RetoMickey b) Clarity of the photograph (the image must have the necessary resolution to be appreciated by other participants) c) Clarity of the content (it must be distinguishable that it is the recipe from the class) d) Final presentation of the recipe (it must be similar to the one shown in the class) f) Consistency with the content requested in the class. g) Only publicly accessible photographs uploaded on Facebook and Instagram will be considered. 5.- Validity*: You can participate until July 24, 2019. The 3 winners will be announced on July 26, 2019, through a post on Kiwilimón®'s Facebook account. Kiwilimón® will contact the winner through this same social network and via email at concursos@kiwilimon.com *The validity of the contest may be extended at Kiwilimón®'s discretion. 6.- Winner's Prize: 3 winners will be selected who will receive as a prize 3 kits with Mickey Mouse kitchen accessories shown in the class. The personal data and address of each winner will be requested via email at concursos@kiwilimon.com to send the kits by courier within 10 to 20 business days. Currently, this contest is only for residents in Mexico. Participation in this contest implies acceptance of these conditions. The user who participates in this contest expressly acknowledges that the photograph with which they compete has not been taken from any other source and/or altered, but is original, thus recognizing and guaranteeing that it does not violate any third-party intellectual property rights; likewise, they commit to hold Kiwilimón® harmless from any claim, lawsuit, or legal action from third parties that may arise, as well as to indemnify it for any expenses incurred by Kiwilimón® in the event of any controversy. Likewise, it is understood that by participating in this contest: (i) the user expressly and irrevocably transfers free of charge to Kiwilimón all patrimonial rights derived from the photographs that users send to Kiwilimón® to participate, reserving no rights for the user. For these purposes, “patrimonial rights” are understood as those indicated in Articles 24 to 29 and other relevant and applicable provisions of the Federal Copyright Law; and (ii) the user expressly authorizes Kiwilimón® to reproduce the photograph(s) with which they participate, even if such photographs include images of themselves or individuals participating in this contest, understanding such images as “moral rights” in terms of Articles 18 to 23 and other relevant and applicable provisions of the Federal Copyright Law, reserving no rights for the user. By virtue of the above, Kiwilimón® will be empowered to exploit any of the photographs that the user shares to participate in the contest, including but not limited to: disclosure, dissemination, publication, production, transmission, printing, recording, editing, exhibition, modification, instrumentation, public communication, distribution to the public (with or without advertising purposes), translation, reproduction, adaptation, compilation, paraphrasing, arrangement, or any other form of exploitation permitted by the Federal Copyright Law and Articles 16, 21, 24, 30, 31, 83 bis and other relevant and applicable provisions of the same regulation, as well as the relevant legislation. Such exploitation may be carried out in the United Mexican States or abroad. By virtue of the above, Kiwilimón® will be the sole owner of the patrimonial rights of authorship derived from the photographs; consequently, Kiwilimón® may in turn transfer, license, encumber, or alienate in any way these rights, either wholly or partially when deemed appropriate, without the undersigned having any right to subsequent payment.
