  General Conditions of the Contest Live Class – De’Longhi Group - Braun KIWILIMÓN®   GENERAL CONDITIONS OF THE CONTEST This contest is presented by Kiwilimón, S.A.P.I. de C.V. (“Kiwilimón®”) and DELONGHI MEXICO S.A. de C.V.   1.- Conditions to participate: All users residing in the United Mexican States (Mexico) may participate. IMPORTANT: if you are selected and live outside Mexico City and/or the Metropolitan Area, travel expenses will be covered by Kiwilimón®. Contest Features: The user must upload a photograph in the comments of the live class (Facebook Live®) or in the posts on the Facebook® social network related to it, showing the result of the preparation of one of the two recipes shown in the class (Crab Cakes or Cheese Broth) The user must follow the presented recipe; however, it can have the presentation that the user prefers. Those who upload their photograph between November 14 and 21, 2018, will participate. The 3 (three) winning photographs will be selected by the De’Longhi Group - Braun team. 2.- Editorial Principles: Through this contest, Kiwilimón® aims to promote: a) Honesty: The photograph you share must be your own. b) Respect and camaraderie: Kiwilimón® through this and all its contests seeks to communicate among users as well as with the page administrators, in search of a space that connects users' ideas and creativity, therefore we appreciate if you avoid making negative comments about other people who are competing. For the above, to safeguard these principles, Kiwilimón® reserves the right to disqualify from the contest any user who exhibits behavior contrary to the principles stated in sections a) and b) of this point, at its sole discretion and without prior notice. Likewise, Kiwilimón® reserves the right to disqualify from the contest all those participants who alter or attempt to alter or manipulate the contest. 3.- Contest Mechanics: To participate in this contest: a) Watch the Live Class on November 14 at 7:00 PM CST via the Facebook® social network. b) Prepare one of the two recipes shown in the class and take a photograph of it. c) Upload your photograph from November 14 to 21 in the comments of the live class video broadcast through Kiwilimón®'s Facebook® social network or in the related Facebook posts. d) The winners will be announced on November 26, 2018. 4.- Selection Criteria: The finalists will be chosen by the De’Longhi Group - Braun team according to the following criteria: a) Sharpness of the photograph (the image must have the necessary resolution to be appreciated by other participants) b) Clarity of the content (it should be distinguishable that it is the recipe or recipes from the live class) c) Final presentation of the recipe. d) Image quality. e) Consistency with the content requested in the class. 5.- Duration*: You can participate from November 14 until November 21, 2018.   The two winners will be announced on November 26, 2018, through a post on Kiwilimón®'s Facebook® account. Kiwilimón® will contact the winner through this same social network and via email at concursos@kiwilimon.com *The duration of the contest may be extended at Kiwilimón®'s discretion. 6.- Prizes:   Three winners will be chosen with different prizes, distributed as follows:   1st place – “Braun Multiquick 777” hand mixer   2nd place – “Braun Multiquick 725” hand mixer.   3rd place – “Braun Multiquick 505” hand mixer.   If the winners reside in Mexico outside Mexico City and the Metropolitan area, their address will be requested for shipping. If they live within Mexico City and the Metropolitan area, the winner must pick up the prize at the address: Bosques de Radiatas N° 10, Second Floor, Colonia Bosques de las Lomas, Cuajimalpa de Morelos, C.P. 05120, Mexico City, and must present an official ID.   Currently, this contest is only for residents in Mexico. Participation in this contest implies acceptance of these conditions. The user who participates in this contest expressly acknowledges that the photograph with which they enter has not been taken from another source and/or altered, but is original, and therefore acknowledges and guarantees that it does not violate any third party intellectual property rights; likewise, they agree to indemnify and hold Kiwilimón® harmless from any claim, lawsuit, or legal action from third parties that may arise, as well as to indemnify it for any expenses incurred by Kiwilimón® in the event of any controversy. Furthermore, it is understood that by participating in this contest: (i) the user expressly and irrevocably transfers free of charge to Kiwilimón all patrimonial rights derived from the photographs that users send to Kiwilimón® to participate, reserving no rights for the user. For these purposes, patrimonial rights refers to those indicated in articles 24 to 29 and other relevant and applicable provisions of the Federal Copyright Law; and (ii) the user expressly authorizes Kiwilimón® to reproduce the photograph(s) with which they participate, even if such photographs include images of themselves or persons participating in this contest, understood as moral rights in terms of articles 18 to 23 and other relevant and applicable provisions of the Federal Copyright Law, reserving no rights for the user. By virtue of the above, Kiwilimón® shall be the sole holder of the patrimonial copyright derived from the photographs; as a consequence, Kiwilimón® may also assign, license, encumber, or alienate these rights in any form, either totally or partially, when it deems appropriate, without the subscriber having any right to subsequent payment.
