GENERAL CONDITIONS OF THE “Live Class – Qualtia®” CONTEST
KIWILIMÓN®

This contest is presented by Kiwilimón, S.A.P.I. de C.V. (“Kiwilimón®”) and (Qualtia®) and organized by Kiwilimón® and Qualtia®, companies legally established in the United Mexican States.

Participants will compete by submitting a photograph of their dish with the presentation they prefer and will publish it during the live class that will be held, or in Kiwilimón@’s Facebook posts showing the result of the preparation of the recipe that will be demonstrated in the live class, all of which will be carried out under the specifications, indications, terms, and conditions of this campaign.
The winner's photograph(s) will be selected by Qualtia®.

1.- Conditions to participate:
All participants residing in the United Mexican States (Mexico) may participate.

If you are selected and live outside Mexico City and/or the Metropolitan Area, travel expenses and shipping will be covered by Kiwilimón® and Qualtia®.

2.- Principles of the Campaign:
Through this contest, Kiwilimón® seeks to promote:
a) Honesty: The photograph you share must be your own.
b) Respect and camaraderie: Kiwilimón®, through this and all its contests, aims to connect participants with each other, as well as with the administrators of the page, in the pursuit of a space that connects the ideas and creativity of the participants. Therefore, we appreciate if you avoid making negative comments towards other competitors.
For the above, to safeguard these principles, Kiwilimón® and Qualtia® reserve the right to disqualify any participant from the contest who exhibits behavior contrary to the principles outlined in subsections a) and b) of this point, at their sole discretion and without prior notice. Also, Kiwilimón® and Qualtia® reserve the right to disqualify from the contest any participants who alter or attempt to alter or manipulate the contest.

3.- Contest Mechanics:
To participate in this contest, the following must be adhered to:
a) Watch the live class broadcast on September 30, 2020, at 5:00 PM through the Kiwilimón® Facebook account.
b) Prepare one of the recipes shown in the class and take a photograph of it.
c) Upload your photograph from September 30 to October 7, 2020 in the comments of the live class video, in the posts published through Kiwilimón®’s social network on Facebook®, or on Instagram mentioning @kiwilimon and @CaperucitaMx.
d) The winner will be announced on October 10, 2020 in a post on Kiwilimón®’s Facebook account.

4.- Selection Criteria:
The finalists will be chosen by the Qualtia® team according to the following criteria:
a) Clarity of the photograph (the image must have the necessary resolution to be appreciated by other participants).

b) Clarity of the content (it must be clear that it is the recipe from the live class).

c) Final presentation of the recipe (it should be similar to that shown in the live class).

d) Consistency with the content requested in the class.

e) Only photographs uploaded to the Facebook social network will be considered according to subsections “a” and “c” of numeral “3” of this campaign.

5.- Validity*:
Participants may enter under the terms indicated in subsections “a” and “c” of numeral “3” of this campaign.
Participants can enter until October 7, 2020.

The winner will be announced on October 10 of the same year through a post on Kiwilimón®’s Facebook account. Kiwilimón® will contact the winner through this same social network and via email at concursos@kiwilimon.com
*The validity of the contest may be extended at the discretion of Kiwilimón®.

6.- Winner's Prize:
There will be 1 (one) winner who will receive the following prize:

1st place - High-end cookware set.

The winner's personal data and address will be requested via email at concursos@kiwilimon.com for shipping by courier within 10 to 20 business days.

Currently, this contest is only for residents in Mexico. We appreciate your understanding if you reside abroad, but we invite you to closely follow all Kiwilimón® contests.

7.- Exclusion of Liability:
Kiwilimón® and Qualtia® are not responsible for failures or errors that occur at any stage of this contest due to fortuitous event or force majeure, including any system failure and/or social network used that is not attributable or foreseeable.

Participation in this contest implies acceptance of these conditions. The participant in this contest expressly acknowledges that the photograph with which they compete has not been taken from another source and/or altered, but is original, and therefore acknowledges and guarantees that it does not violate any third-party intellectual property rights; likewise, they undertake to hold Kiwilimón®, Qualtia®, and any of their affiliates harmless from any claim, demand, or legal action from any authority or third party that may arise, as well as to indemnify them for any expenses incurred by Kiwilimón® and/or Qualtia®; or any of their affiliates, as well as anyone representing their rights in the event of any dispute.
It is understood that by participating in this contest: (i) the participant expressly and irrevocably grants to Kiwilimón® and Qualtia® all the economic rights derived from the photographs that participants send to Kiwilimón® and Qualtia® to participate, reserving no rights for the participant.
For these purposes, “economic rights” are understood as those mentioned in articles 24 to 29 and other applicable provisions of the Federal Copyright Law; and (ii) the participant expressly authorizes Kiwilimón® and Qualtia® to reproduce the photograph(s) with which they participate, even if such photographs include images of themselves or others participating in this contest, understood as “moral rights” under articles 18 to 23 and other applicable provisions of the Federal Copyright Law, reserving no rights for the participant. By virtue of the above, Kiwilimón® and Qualtia® will be empowered to exploit any of the photographs shared by the participant to enter the contest, including the following non-limiting examples: dissemination, publication, production, transmission, printing, recording, editing, exhibition, modification, instrumentation, public communication, distribution to the public (with or without advertising purposes), translation, reproduction, adaptation, compilation, paraphrasing, arrangement, or any other form of exploitation permitted by the Federal Copyright Law and the articles 16, 21, 24, 30, 31, 83 bis, and other relevant provisions of the same regulation, as well as the applicable legislation. This exploitation may be carried out in the United Mexican States or abroad.

By virtue of the above, the sponsors will be empowered to exploit any of the participants' photographs, including the following non-limiting examples: dissemination, publication, production, transmission, printing, recording, editing, exhibition, modification, instrumentation, public communication, distribution to the public with or without advertising purposes, translation, reproduction, adaptation, compilation, paraphrasing, arrangement, or any other form of exploitation permitted by law and other applicable legislation. This exploitation may be carried out in the United Mexican States.
