The site https://www.facebook.com/kiwilimon is operated by Kiwilimón, S.A.P.I. de C.V. ("Kiwilimón"), located at Avenida General Mariano Escobedo No.555, 1st Floor, Office 1A, Rincón del Bosque Neighborhood, Miguel Hidalgo Borough, C.P. 11580, Mexico City, Mexico.

The Responsible party is a legally constituted entity under Mexican laws and is committed to the protection of all Personal Data and Sensitive Personal Data that you provide.

This Privacy Notice (the "Notice") is made known in accordance with articles 16 and 17 of the Federal Law on the Protection of Personal Data Held by Private Parties (the "Law"), and aligns with the international standards necessary for the security of our users' information. The Law aims to protect Personal Data in the possession of private parties, in order to regulate its legitimate, controlled, and informed processing, and to guarantee the privacy and the right to informational self-determination of individuals who are users of the Kiwilimón website. This Notice applies to any website, application, service, or tool of Kiwilimón (collectively referred to as the "Services") in which this privacy notice is mentioned, regardless of how you access or use said services, including through mobile devices. By virtue of the foregoing and this Notice, you will have full control and decision over your Personal Data. Therefore, we recommend that you carefully read the following information.

I. DEFINITIONS
Cookies: Cookies are text files that are automatically downloaded and stored on the user's computer hard drive when browsing a specific Internet page, allowing the Internet server to remember certain data about this user, including their preferences for displaying pages on that server, name, and password.
Personal Data:
Any information concerning you.
Sensitive Personal Data: Those personal data that affect the most intimate sphere of its owner, or whose improper use may give rise to discrimination or pose a serious risk to them. In particular, sensitive data includes information that may reveal aspects such as racial or ethnic origin, current and future health status, genetic information, religious, philosophical, and moral beliefs, union affiliation, political opinions, sexual preference.
ARCO Rights: The rights of access, rectification, cancellation, and opposition provided in article 22 of the Law.
IP Address: A sequence of numbers used to identify an electronic device within a network specifically configured for the use of such addresses.
Law: Federal Law on Personal Data Held by Private Parties.
Logs: Logs (in Spanish, bitácora) refer to one or more text files automatically created and managed by a server, where all activity performed on it is stored. Each server, depending on its implementation and/or configuration, may or may not create certain logs.
You: The identified or identifiable natural person to whom the Personal Data and Sensitive Personal Data pertain.
Responsible: Kiwilimón, S.A.P.I. DE C.V., who will carry out the processing of Personal Data and Sensitive Personal Data.

II. PROCESSING OF INFORMATION AND PERSONAL DATA
For the fulfillment of the purposes of this website, if you choose to participate in the survey, Kiwilimón will collect your personal information mentioned below:
  • Your responses to the survey questions and form fields
  • Your IP address
  • The date and time you completed the survey or submitted the form
  • Contact details you may provide, such as your email address
  • Cookies such as those used for performance monitoring
You are not obligated to respond to the survey; however, if you do respond, you agree that Kiwilimón may collect and use your data for legitimate interests and for the purposes described in this Privacy Notice. Additionally, you will be entitled to 2 months free of Kiwilimón App Pro, starting from its launch date (November 3, 2020).

This data will be collected directly through the registration you complete on this site. Kiwilimón will not at any time request Sensitive Personal Data. Financial or property data will also not be requested. Kiwilimón does not collect information from users under thirteen years of age residing in Mexico or abroad.

As a result of the above, Kiwilimón will be responsible for the use given to your Personal Data, as well as its protection. To this end, Kiwilimón implements technical, administrative, and physical security measures as specified in the Regulation of the Law, which protect your Personal Data against any damage, partial or total loss, modification, alteration, handling, destruction, or unauthorized use, access, processing, or safeguarding, whether in digital or physical files.

As the owner of the collected Personal Data, you have the right to limit the use and disclosure of your data by sending a request to the email address info@kiwilimon.com, provided that, in accordance with the principle of purpose set out in the Law and its Regulation, such limitation of use and disclosure is justified and does not exceed the scope of the purposes outlined in Section II of this notice.

You can also exercise your rights of Clarification, Rectification, Cancellation, or Opposition (ARCO) regarding your personal data, in accordance with the provisions of the law, via email, indicating in your request your full name and the personal data regarding which you seek to exercise any of the stated rights. After receiving your request, all notifications will be sent to the email address you provided when registering on the site or, if applicable, by other means specified in your request.

In the operation of the website, third-party cookies are used when you log in through social networks or through their links on this website. Therefore, connecting to the site through social networks is governed by the privacy policies of those networks.

In any case, you can disable cookies in your browser's settings options, according to the manual. However, the tools and links to social networks on the website cannot be disabled due to their mode of operation. If you disclose your information to a third party or visit a third-party website through a link in our Services, the privacy notices and practices of that third party will apply to any personal information you provide or that third party collects from you.

We cannot guarantee the privacy or security of your personal data once you provide it to a third party; therefore, we encourage you to evaluate the privacy and security policies of any third party before making any inquiries, transactions, or visits and decide to share your personal data. This is true even if the third parties to whom you disclose your personal data are individuals or entities interacting on our website as users or advertisers.

III. PURPOSE OF THE PROCESSING OF DATA
Your Personal Data may be used for the following: (i) to fulfill the corporate purpose of Kiwilimón; (ii) to develop statistical studies, programs, reports, and projects related to Kiwilimón's activities; (iii) to send you all types of communications regarding Kiwilimón and/or any of its services; (v) to establish communication and contact with you, as the owner of the Personal Data; and (vi) to generate improvements on the website owned by Kiwilimón www.kiwilimon.com and/or any other site that Kiwilimón indicates for these purposes.

The processing of the Data provided by you to the Responsible party will be limited to fulfilling the purposes outlined in this Notice and for other purposes that are compatible or analogous to those established in this Notice, without requiring further consent.

By making this Notice available to you and not expressing any opposition, it will be understood, in accordance with article 8 of the Law, that you grant the Responsible party your consent to carry out the processing of the Data that have been provided and/or those that you may provide in the future due to any of the purposes established in this Notice, whether personally or through agents, promoters, brokers, or business partners, as well as through any electronic, optical, sound, audiovisual means or any other technology or medium operated or administered by the Responsible party. Express consent will not be necessary for the processing of Data when its handling aims to fulfill obligations arising from a legal relationship between you and the Responsible party, nor in other cases contemplated in article 10 of the Law. This is without prejudice to your ability to exercise ARCO Rights in accordance with the Law.

The Responsible party informs that any unprotected email communication made over the internet may be subject to interception, theft, loss, or possible alterations, in which case you will not be able to claim any compensation from the Responsible party for any damage resulting from interception, theft, loss, or alteration.

Likewise, we inform you that Kiwilimón will collect and maintain your personal data for as long as necessary to provide you with the Services you may have requested, or simply for using the Kiwilimón website, as well as to resolve any disputes or enforce compliance with this Notice.

IV. MEANS TO EXERCISE ARCO RIGHTS
You, either personally or through a duly accredited legal representative, may exercise the rights of access, rectification, cancellation, and opposition against the Responsible party.

To do this, you or your legal representative may submit this request in writing containing at least the following information and/or documentation:
  1. The name and address of the owner or any other means to receive the response (if the owner omits the address or any other means they have chosen to contact them, the request will be deemed unreceived).
  2. A clear and precise description of the personal data regarding which the owner seeks to exercise any of the rights.
  3. If applicable, other elements or documents that facilitate the location of the personal data.
  4. Your valid official identification (For example: Voter ID issued by the National Electoral Institute, Passport issued by the Ministry of Foreign Affairs, or Professional License);
  5. In cases where the exercise of ARCO Rights is carried out through your legal representative, they must provide (i) valid official identification of the legal representative, and (ii) the corresponding power of attorney; and
  6. In cases of the right of rectification, documentation supporting the requested change must be included according to the data to be rectified.
The response to this request will be carried out by the Responsible party within 20 (twenty) working days from the date the request was received. The Responsible party may extend this period for an additional 20 (twenty) working days, when the case warrants it, after notifying you.

The response to the request will be communicated to you via the email provided in your request or by sending postal mail to the address indicated for these purposes in your request. The delivery of the Data, in the case of exercising the right of access, will be free, and you will only need to cover the justified shipping costs or the cost of reproducing copies or other formats. However, if you reiterate your request within a period of less than twelve months, the costs will be as indicated in the Law, unless there are substantial modifications to the Notice that warrant new inquiries.

V. DATA TRANSFER
The Responsible party is committed to ensuring compliance with all legal principles of protection concerning the transfer of the Data provided by you. Likewise, it expresses its commitment to ensure that this Notice is respected at all times by the individuals or entities to whom the provided Data may be transferred.

The Responsible party may transfer the Data among subsidiaries and all its affiliates for the purposes indicated in Section II of this Notice, as well as to third parties with whom it enters into any type of agreement and/or contract.

National or international transfers of Data may be carried out without your consent, provided that (i) the transfer is made to controlling, subsidiary, or affiliated companies under the common control of the Responsible party, or; (ii) it is made to a parent company or any company in the same group as the Responsible party operating under the same internal processes and policies, or (iii) it is necessary due to a contract entered into or to be entered into in your interest, by the Responsible party and a third party; or (iv) when the transfer is necessary for the maintenance or fulfillment of a legal relationship between the Responsible party and you; or (v) it is necessary to assist any government institutions in any type of investigation of criminal conduct, offenses, inquiries against individuals or entities, as well as federal or international agencies with the same purposes; or (vi) when the transfer is made to prevent, detect, mitigate, and investigate potentially illegal acts, fraud, or security breaches and assess risk management, including sending alerts to you about the detection of any fraudulent activities; or (vii) in the event of a merger with another company or an acquisition by another company, we may share information with them in accordance with our national and international privacy protection standards. In the event such an event occurs, we will require that the resulting new entity comply with this privacy notice concerning your personal data.

Should we intend to use your personal data for any purpose not established in this privacy notice, you will receive prior notification regarding the processing of your personal data for the new purposes.

You have the right to oppose the processing of your Data if you do not agree with the modifications that may be presented in this Notice. To exercise your right of opposition, you must send a request to exercise ARCO Rights, in accordance with what is indicated in Section V of this Notice.
