General Terms of the Contest "Live Class - Regio Advanced®"

GENERAL TERMS OF THE CONTEST

This contest is presented by Kiwilimón, S.A.P.I. de C.V. (“Kiwilimón®”) and Essity Hygiene and Health Mexico S.A. de C.V. (“Regio Advanced®”)

 

1.- Conditions to participate: All users residing in the United Mexican States (Mexico) may participate. IMPORTANT: if selected and living outside Mexico City and/or the Metropolitan Area, travel expenses will be covered by Kiwilimón®.

Contest Features:

• The user must upload a photograph in the comments of the live class on Facebook Live® or in the posts made about it showing the result of the preparation of the breaded chiles en nogada that was shown in the class.

• It must be the same dish; however, it can have the presentation that the user prefers.

• Those who upload their photograph within the dates of September 12 to 19, 2018. will participate.

• The winning photograph will be selected by Regio Advanced®.

2.- Editorial Principles: Through this contest, Kiwilimón® aims to promote:

1. a) Honesty: The photograph you share must be your own.

1. b) Respect and camaraderie: Kiwilimón® seeks to communicate among users, as well as with the page administrators, in the pursuit of a space that connects the ideas and creativity of users, so we appreciate it if you avoid giving negative comments to others competing.

For the above, to safeguard these principles, Kiwilimón® reserves the right to disqualify any user from the contest who exhibits behavior contrary to the principles outlined in sections a) and b) of this point, at its sole discretion and without prior notice. Likewise, Kiwilimón® reserves the right to disqualify from the contest any participants who alter or attempt to alter or manipulate the contest.

3.- Contest Mechanics: To participate in this contest:

1. a) Watch the Live Class on September 12 through the social network Facebook®.

1. b) Prepare the Breaded Chiles en Nogada shown in the class and take a photograph of it.

1. c) Upload your photograph from September 12 to 19 in the comments of the live class video broadcast through Kiwilimón's social network on Facebook® or in the posts from Braun® regarding the broadcast.

1. d) The winner will be announced on September 25 through a post on Kiwilimón®'s social media account on Facebook®.

4.- Selection Criteria: The finalist will be chosen by the Regio Advanced® team according to the following criteria:

1. a) Sharpness and Quality of the Photograph: your photograph must be well focused by the camera or instrument with which it is taken, and must have good lighting; avoid dark environments or taking it from too far away - more than one and a half meters.

1. c) Final Presentation of the Recipe: the final taste of a recipe is essential, but it is not enough for it to just taste good; its presentation and decoration are equally important, so show us your best skills through your photograph, don't forget the minimal details, from the plate it is presented on, the way you arrange the food, the contrasting colors of both the food and all elements around, the proportions of the food and the plate, among others, let your imagination soar.

1. e) Consistency with the content requested in the class: we seek the recipe to be made according to what was explained in the live class, and that it has your personal touch; you can add an extra ingredient to the content in the original recipe shown in the live class, but photographs showing recipes that are completely different from the one explained in the live class will not be accepted.

5.- Validity*:

• You can participate from September 12 to 19, 2018.

• The winner will be announced on September 25 through a post on Kiwilimón®'s social media account on Facebook®. Kiwilimón® will contact the winner through this same social network.

*The validity of the contest may be extended at Kiwilimón®'s discretion.


6.- Winner's Prize: The winner will receive a 60 oz Blender, 5 speeds with a 0.9hp motor of excellent quality.

If the winner resides in Mexico outside Mexico City and the Metropolitan Area, their address will be requested for shipping. If they live within Mexico City and the Metropolitan Area, the winner must pick up the prize at the address: Bosques de Radiatas N° 10, Second Floor, Colonia Bosques de las Lomas, Delegación Cuajimalpa de Morelos, C.P. 05120, Mexico City, and must present an official identification.

Currently, this contest is only for residents in Mexico. We appreciate your understanding if you reside abroad, but we invite you to keep a close eye on all Kiwilimón® contests.
 
7.- Disclaimer: Kiwilimón® and Regio Advanced® are not responsible for failures or errors that occur at any stage of this contest due to fortuitous events or force majeure, including any failure in the system and/or social network used that is not attributable or foreseeable.

Participation in this contest implies acceptance of these terms. The user participating in this contest expressly acknowledges that the photograph with which they compete was not taken from another source and/or altered, but is original, thus recognizing and guaranteeing that it does not violate any third-party intellectual property rights; likewise, they commit to indemnify and hold Kiwilimón® harmless from any claim, lawsuit, or legal action from a third party that may arise, as well as to indemnify any expenses incurred by Kiwilimón® in the event of any controversy. Additionally, it is understood that by participating in this contest: (i) the user expressly and irrevocably transfers free of charge to Kiwilimón all patrimonial rights derived from the photographs that users send to Kiwilimón® to participate, without reserving any rights; for such purposes, "patrimonial rights" are understood as those indicated in Articles 24 to 29 and other relevant and applicable provisions of the Federal Copyright Law; and (ii) the user expressly authorizes Kiwilimón® to reproduce the photograph(s) with which they participate, even if such photographs include images of themselves or persons participating in this contest, understood as "moral rights" in terms of Articles 18 to 23 and other relevant and applicable provisions of the Federal Copyright Law, without reserving any rights. By virtue of the foregoing, Kiwilimón® will be empowered to exploit any of the photographs that the user shares to participate in the contest, including but not limited to: disclosure, dissemination, publication, production, transmission, printing, recording, editing, exhibition, modification, instrumentation, public communication, distribution to the public (with or without advertising purposes), transference, reproduction, adaptation, compilation, paraphrasing, arrangement, or any other form of exploitation permitted by the Federal Copyright Law and Articles 16, 21, 24, 30, 31, 83 bis and other relevant and applicable provisions of the same regulation, as well as the legislation on the matter. Such exploitation may be carried out in the United Mexican States or abroad.

By virtue of the foregoing, Kiwilimón® will be the sole holder of the patrimonial copyright derived from the photographs; consequently, Kiwilimón® may in turn assign, license, encumber, or transfer these rights in any form, either in whole or in part, as it sees fit, without the participant having any right to subsequent payment.
