General Conditions of the Contest “Recipe of the Year”

Starting from November 20, 2020, upload your best recipe to www.kiwilimon.com, whether it’s your family’s recipe, the one your friends ask for at every party, or the most creative one. Upload it with the title of the dish, your name, and the hashtag: #Larecetadelaño.
GENERAL CONDITIONS
1. Conditions to participate: All users of the Kiwilimón www.kiwilimon.com site residing in the United Mexican States (Mexico) may participate.

• Recipe Characteristics:

The recipe must meet the following guidelines:
  1. The photograph can be taken with a cell phone, either in vertical or horizontal format.
  2. It must be in community recipe format, with a photograph, complete recipe -with ingredients and procedure-, title of the dish, history of the dish, the name of the contestant, and the hashtag: #Larecetadelaño.
  3. The recipe must clearly and precisely describe:
  1. The description of the dish, why you believe it should be the best recipe of Kiwilimón, tell us about the importance of your recipe, its history, and its flavor.
  2. List the ingredients and quantities to be used, that is, the recipe must specify the ingredients and the amounts to be used, and if applicable, whether the ingredients are replaceable or if a particular kitchen utensil should be used.
  3. Describe step by step the procedure for making the dish, that is, indicate the number of servings and preparation time.

2.- Editorial Principles: Through this contest, Kiwilimón seeks to promote:
a) Honesty: The photograph you share of your recipe must be your own. We seek the recipe to have an original and creative touch.
b) Respect and camaraderie: Kiwilimón, through this and all its contests, aims to communicate among users, seeking a space that connects users' ideas and creativity, so we appreciate if you avoid making negative comments about other participants.
Therefore, to safeguard these principles, Kiwilimón reserves the right to disqualify any user from the contest who exhibits behaviors contrary to the principles outlined in subsections a) and b) of this point, at its sole discretion and without prior notice. Likewise, Kiwilimón reserves the right to disqualify all participants who alter or attempt to alter or manipulate the contest.

3.- Contest Mechanics: To participate in this contest:
a) Starting from November 20, 2020, upload a photograph of your dish with your best recipe, whether it’s your family’s recipe, the one your friends ask for at every party, or the most creative one to the Kiwilimón www.kiwilimon.com page.
- Upload it with the title of the dish, your name, and the hashtag: #Larecetadelaño.
- Describe your dish and why you think it should be the best recipe of Kiwilimón. Tell us what you consider important about it: its history, why it is so special for you or others, its flavor.
- Describe the ingredients with measurements and the step-by-step procedure.
b) You can share your photograph by uploading it to the Kiwilimón www.kiwilimon.com page starting from November 20 until December 13, 2020. If you have any difficulty uploading the recipe to the website, feel free to send us your questions at info@kiwilimon.com
c) Once the period for uploading photographs with the participating recipes concludes, our group of experts will choose the 12 (twelve) best recipes and finally one winning recipe, who will be contacted to receive the assigned prizes later.

4.- Selection Criteria: The finalist will be chosen by the Editorial team of Kiwilimón, according to the following criteria:
  1. The description and the story of why that recipe is important or significant to you.
  2. Your recipe must be original and not copied: it must be a personal or family recipe.
  3. It must be delicious!
  4. Chef Mau Eggleton, the cooking team, experts in gastronomy, and Kiwilimón editors will decide the 12 recipes for the recipe book and the Recipe of the Year.
5.- Validity*:
• Submission of photograph with the recipe: from November 20 to December 13, 2020.
• Announcement of the winner(s): December 22, 2020.
*The validity of the contest may be extended at Kiwilimón's discretion.

6.- Prizes for the winners: The 12 best recipes will be included in Kiwilimón's recipe book of the year, a video of their recipe will be recorded and published throughout 2021, and they will receive Kiwilimón recipe books and tableware from the brand Anfora.
The Best Recipe of the Year will win Kiwilimón's Tableware of the Year, handcrafted and painted by Anfora. In addition, their recipe will be cooked in a live class with our home chef Mau Eggleton on December 22 and will be recorded in our studios with their name and published throughout 2021.

7.- Location and date of the Live Broadcast: The live class with our home chef Mau Eggleton will be broadcast from the Kiwilimón kitchen on December 22, 2020, at the following address: General Mariano Escobedo 555, Floor 1, Rincón del Bosque, Miguel Hidalgo, CP. 11580.

8.- Exclusion of liability: Kiwilimón is not responsible for any failures or errors that occur at any stage of the video contest due to fortuitous events or force majeure, including any system failure that is not attributable to or foreseeable by it.

Participation in this contest implies acceptance of these conditions. The user participating in this contest expressly acknowledges that the Recipe with which they compete has not been taken from any other source and/or altered, but is original, thus recognizing and guaranteeing that it does not violate any third-party intellectual property rights; they also commit to indemnify and hold Kiwilimón harmless from any claim, demand, or legal action by a third party that may arise, as well as to indemnify Kiwilimón for any expenses incurred in case of any dispute. Furthermore, it is understood that by participating in the contest: (i) the user expressly and irrevocably grants Kiwilimón all the property rights derived from the images that users send to Kiwilimón to participate, as well as from the Recipe that the winner of this contest prepares, reserving no rights for the user. For such purposes, “property rights” are understood as those indicated in Articles 24 to 29 and other related and applicable provisions of the Federal Copyright Law; and (ii) the user expressly authorizes Kiwilimón to reproduce images of themselves or persons participating in the Recipe, understood as “moral rights” in terms of Articles 18 to 23 and other related and applicable provisions of the Federal Copyright Law, reserving no rights for the user. Consequently, Kiwilimón will be empowered to exploit any of the images the user shares to participate in the contest, including but not limited to: dissemination, publication, production, transmission, printing, recording, editing, exhibition, modification, instrumentation, public communication, distribution to the public (with or without advertising purposes), transfer, reproduction, adaptation, compilation, paraphrasing, arrangement, or any other form of exploitation permitted by the Federal Copyright Law and Articles 16, 21, 24, 30, 31, 83 bis, and other related and applicable provisions of the same legal framework, as well as the applicable legislation. Such exploitation may be carried out in the United Mexican States or abroad.

In view of the above, Kiwilimón will be the sole holder of the property rights derived from the images and/or videos; as a result, Kiwilimón may, in turn, assign, license, encumber, or alienate these rights in any form, either totally or partially, as it deems appropriate, without the undersigned having any right to subsequent payment.
